Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to HYPERSENSIUM.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

 

The HYPERSENSIUM provides information, services, and products for registered users and casual users alike through its Site. Written, video and audio resources may be available, and the Site may also allow users to book online courses and events, purchase publications, products and get access other general information.

Access to certain services will require registration with the Site or Application and certain areas may be restricted to registered users only.

These terms will apply to customers who have booked, purchased or paid for goods or services using the Site, to registered users and to those who simply view the Site (“you”).

By using the Services, you agree to be bound by these Terms of Use and Purchase. Please note that separate terms may apply to certain courses, events, products or goods and other Services which are provided by any means other than via our Site.

Please note that these terms and conditions may be amended from time to time. Notification of any changes will be made by us posting new terms onto the Site. In continuing to use the Site you confirm that you accept the then current Terms of Use and Purchase in full at the time you use the Services.

  • HYPERSENSIUM reserves all copy rights and intellectual property rights to the fullest extent of the law. You may not record, photograph, distribute, share, copy or scan any of our online events activities, methodologies, art works or educational hand-outs or notes in any way, shape or form, in a professional or personal capacity, utilizing any type of publication, platform, communication methods or distribution efforts or services.

  • Violating our copy rights may lead to hefty fines and even prison sentences under London, United Kingdom and international copyright laws.​

Registration

You can access many of our Services without registering or subscribing but if you wish to view certain content or access certain services, you may be required to register with the Site.

In addition there are certain areas of our Site and certain Services which may only be available to registered members and other areas and Services which may be subject to subscription or payment.

When you register for one of our electronic Services we will ask for certain personal information. Any personal information you provide to us will be handled in accordance with our Privacy and Data Protection Policy.

If you register to use our Services you may be required to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us by contacting hypersensium@gmail.com immediately.

We reserve the right to cancel any registration at any time and for any reason.

Courses and Events Bookings

By making a booking you represent and warrant that you are at least eighteen (18) years old. 

You will be able to make bookings for courses (“Academy”) using the electronic Services.

Your booking is an offer to book an Event and we reserve the right to refuse any request for a booking for any reason at any time and to refund the fees paid.

You must pay your deposit in full at the time you book an Event. Your order will not be complete until we have received payment.

You may pay your deposit by credit or debit card or bank transfer.

We will confirm your order by email and we will send your booking confirmation by email.

You are not entitled to transfer a booking without our consent.

The cancellation policy for the event may be specified when booking but in the absence of any such policy the following will apply

The purchase of our Online-Courses is non-refundable. 

If the Event is organised by us and we cancel the event (which we reserve the right to do) then we will either:

  • provide a booking for an alternative event or date; or

  • if you are unable to attend the re-scheduled meeting or event (if any) or there is no re-scheduled event or meeting then we will provide a refund of the fees paid.

Art and Creative Meditation Courses Details

  • Our Art Courses and Creative Events are made for entertainment purposes only.

  • It is understood that HYPERSENSIUM does not offer any degrees nor are we an accredited academic institution.

  • It is understood that HYPERSENSIUM does not claim to teach all methods of art making, but has a focus on only certain types of art making as set out in our course and Academy descriptions.

  • It is understood that all HYPERSENSIUM Art Courses are created for entertainment purposes, and HYPERSENSIUM is not responsible for your personal development as an artist.

  • It is understood that HYPERSENSIUM Creative Meditation Courses are not intended to diagnose, treat, cure, or prevent any disease or condition. Read more about HYPERSENSIUM MEDITATION SERVICES below.

  • It is understood that HYPERSENSIUM does not accommodate nudes in terms of themes nor subjects as part of our instruction or classroom conduct both in studio and online. This also pertains to any related exhibitions, shows or events we may conduct.

  • We do not conduct any business with minors. You must be 18 years or older to conduct any type of business with us. 

  • You cannot misrepresent our business or damage our reputation or business in any way, shape or form.

  • You may not use our business as a platform for promoting yourself or your art and you may not usurp our business with other individuals, businesses or organizations in any way, shape or form.

  • You may never represent, promote or create anything on behalf of our business or claim unauthorized endorsements from us in any way, shape or form.

  • You are responsible for working with us. We cannot force you to have results. Results depend on your ability and willingness to work with us and continue to build upon what you learn in class, at home, on your own.

Creative Meditation Services, Courses and Info

Our Website and Services also provide Creative Meditation events and courses and information on wellness and meditation.

All information, courses, or retreats provided by HYPERSENSIUM are not intended to diagnose, treat, cure, or prevent any disease or condition. The information contained on this Website is not intended nor is it implied to be a substitute for medical, psychological, financial, legal of other professional advice. Always seek the advice of your medical practitioner or qualified health provider when starting any new practice, exercise regime or continuing with other physical activities or with any questions you may have regarding your health or other medical conditions.

None of the content on this Website or Services represents or warrants that any practice or regime is safe, appropriate, or effective for you. To the extent that we provide any explicit or implied recommendation of any Service, such recommendation is only general and not specific to a particular individual.

Your reliance on any of our Services or information on this Website is solely at your own risk. It is your sole responsibility to inform us of any prior health conditions.

We may report on or display the success of our existing or previous clients or customers. You acknowledge that the prior success of others does not guarantee your success. As your results are based on your individual capacity, background, dedication, motivation, health, and experience. Choosing to use our information, products and Services should be based on your own due diligence and you agree that we are not liable for any success or failure that is directly or indirectly related to the use of our information, products, and Services.

Online Courses Education Material

The course material will be made available in accordance with the course description and, subject to our right to alter or delete any material, will be accessible for the duration of the course. It will not be accessible (save for a limited period at our discretion) after the course is complete. It is strongly recommended that you download all the available material during the term of the course.

Purchase and Delivery of Goods and Products

Delivery will be made to the address specified by you on the completed order form. Our delivery charges will be specified at the time the order is placed.

When you place an order we may not be able to provide an exact date at the time you order, if so then we will endeavour to provide you with an approximate delivery time when you place the order and we or our delivery partners will contact you again by phone when we are able to specify a date.

Whilst we will use reasonable endeavours to deliver the items on the agreed date we will not be liable for any failure to deliver on the stated date or at the stated time.

All the purchases made on our website are non-refundable

Termination

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at Our sole discretion.
